Kerry L. Owens
Kerry Owens is a shareholder and chair of the firm's Real Estate department. He concentrates his practice in the areas of real estate purchase, sale and development, zoning and permitting, financing and loan documentation, and commercial and industrial leasing.
Mr. Owens has been lead counsel in the development of several large multipurpose student housing projects in Utah. He also has significant resort development experience.
Mr. Owens regularly advises clients in connection with the purchase and sale of different types of real property, including commercial buildings, industrial properties, large residential properties, and unimproved land. He represents both tenants and landlords in connection with the negotiation and documentation of commercial leases, and he has represented owners and contractors in the review and negotiation of construction-related contracts.
Mr. Owens has developed special expertise in the development of utility scale wind energy projects. He has represented the developer/operator of the largest wind energy facility in Utah including the negotiation and documentation of acquisitions, land leases and easements, project finance transactions as well as permitting, land use and entitlements.
Mr. Owens’ practice is concentrated on a broad range of land use and regulatory matters, including zoning, real estate and natural resources, infrastructure and development. He regularly represents developers in obtaining entitlements from local governments. Mr. Owens also represents property owners in the negotiation, siting and acquisition of commercial, industrial and residential developments; obtaining water rights, utilities and rights of way; resolution of title defects and disputes; and advising on sales of properties ranging from single parcels to large, multi-phased and multi-use developments. He represents master developers in negotiations related to infrastructure development and land use. His practice also involves advising natural resource developers and public lands users on laws regulating exploration, development and transportation of minerals.
